Terms and Conditions…

Introduction

The following terms and conditions represent the basis upon which I (the driving instructor) offer you (the student) driving tuition. 

  1. General Information and Conduct

1.1. In order to have driving tuition with Learn 2 Drive Academy you must  be aged 17 or over or aged 16 or over and in receipt of the higher rate of Disability Living Allowance (mobility component); and hold a valid UK provisional driving licence; and be legally entitled to drive in the UK.

1.2. The learner must check that they are able to read a  registration plate at a distance of 20.5 metres ( the equivalent about 5 car lengths or 67 feet) with prescribed visual aids (e.g. contact lenses or glasses) if normally worn. If visual aids are normally worn, these must be worn to every driving lesson otherwise the instructor reserves their right to cancel this lesson and the learner may be charged in full.

1.3. Students will be expected to behave in a respectful manner, this includes not smoking or using a mobile during a lesson, any abuse of this may result in the termination of any future driving lessons. In this unlikely event, learners will not be refunded for the terminated lessons.

2. Qualifications and your Instructor

2.1 Your Learn 2 Drive Instructor will behave in a professional, polite manner. They will not use your lesson time for any other purpose. They will not smoke in the car while giving tuition.

2.2 Instructor Qualifications - Your instructor has been licensed by the DVSA (Driver and Vehicle Standards Agency) and has passed all three ADI tests. The instructor will have their ADI badge on display for each lesson.

3. Insurance

3.1 The instructor will have suitable motor insurance, should there be any motor incidents or collisions in the learner vehicle.

4. Payments, Bookings and Refunds 

4.1. Payments must be made prior to the lesson or course commencement. Payments can be made via bank transfer or through the Learn 2 Drive Academy website.

4.2. If a block of lessons is purchased, partial refunds may not be given if you do not decide to continue lessons, although every case will be assessed individually.

4.3. The discounts available with block bookings can only be applied when paid in full.

4.4. Learners must inform the instructor in advance if their pick-up/ drop off location is to change. If sufficient notice is not given, the instructor may have to decline requests or terminate the lesson early if the drop off location is far from the initial location because the instructor needs to allow themselves adequate travel time to their next lesson.

4.5. Lessons purchased in your name can not be sold or transferred to another person.

4.6. If you are eligible for a refund, this will be paid via bank transfer.

4.7. Once training fees have been paid for tuition, this will not be refundable if you decided to cancel. However, this will be assessed under special circumstances. This does not in any way affect your statutory rights to be provided with the goods and services you have purchased.


5. Cancellation and Punctuality

5.1. It is the learner’s responsibility to arrive at their lesson on time. If a learner arrives late, the instructor may not be able to give them back the lesson time missed.

5.2. Your instructor will be responsible for arriving at your pick up point on time, in the rare case they are unable to be punctual. The lesson time lost will be added onto the end of your lesson or if this is not convenient the instructor will add it onto future lessons.

5.3. In the case that your driving instructor has to postpone/ cancel your lesson they will allocate you a new lesson slot that is convenient for you.

5.4. If you cancel your lesson without sufficient notice (48 hours) and your instructor isn’t able to fill your slot, you may be charged in full. Each case will be assessed individually.

5.5. We cannot be held accountable for any time delays caused by traffic.

6. Vehicle

6.1 The learning vehicle will be fitted with dual controls and fully insured for tuition.

6.2 The instructor will ensure that it is kept clean and tidy at all times so that your lesson can be carried out comfortably.

6.3 The learner is responsible for any personal possessions that they decide to bring to their lessons, it would also be appreciated if learners can take any litter belonging to them with them upon completion of the lesson.

7. Driving Test

7.1. Driving test bookings are to be made by you once consulting your instructor to ensure your test will not clash with any other tests.

7.2. Driving test bookings will take priority over other lessons which could lead to your lessons being rearranged to accommodate another student’s test, likewise your test could lead to other students' lessons being rescheduled. Learners will be informed of any changes to their lessons immediately.

7.3. To ensure your safety, the examiners and the public’s safety and also to make sure the risk of damage to the instructor’s car is minimised, the instructor reserves the right to restrict the use of the learner vehicle if the instructor feels you are not ready or fit for the test.

8. Driving under the Influence

8.1. If your instructor has any reason to believe that you are under the influence of either alcohol or drugs then they will terminate your lesson immediately and you will be charged in full for the lesson.

9. Gift Vouchers

9.1. Gift Vouchers can be used for driving tuition only, vouchers have no cash value.

10. Privacy 

10.1 Upon passing your driving test, your driving instructor may ask you to take a photograph with your certificate by the car. By agreeing to this, you agree to this photo being used for marketing purposes e.g. social media.
